General Conditions of Sale

Introduction

This page (together with our Privacy Policy) sets out information about us and the legal terms and conditions (the "Terms" or "General Conditions of Sale") on which we sell the sun care products ("Products") listed on the Sunsense website (the "Website") to you.

These Terms apply to any contract between us for the sale of Products to you via the Website ("Contract"), to the exclusion of all other documents. Please read these Terms carefully before ordering. Before placing an order, you will be asked to confirm your agreement to these Terms. If you do not accept them, you will not be able to order Products from our Website.

We recommend you save or print a copy of these Terms for your records.

We may amend these General Conditions of Sale from time to time, as set out in Clause 8. Please check these Terms each time you place an order, to ensure you understand the version that applies to your purchase.

These Terms and any Contract between us are concluded in the English language.

Products are intended for personal use and not for resale or commercial use.

All orders placed via the Website imply consultation and express acceptance of these General Conditions of Sale, without requiring a hand-written signature. In accordance with Dutch and EU electronic commerce regulations governing the formation of electronic contracts, the recording and validation of the order, as described in Clause 6 ("Placing an Order"), constitutes the placing of an order between us.

For general questions, feedback, or complaints about our Products or brand, or for questions about placing an order, purchases, or deliveries, please contact our Customer Care team at oceanproducts.worldwide@gmail.com, quoting your order number where applicable.

If we need to contact you or give you notice in writing, we will do so by email, using the address you provided when placing your order.

2. Use of Our Website

Your use of our Website is also governed by our Website Terms and Conditions and Privacy Policy, which contain important terms that apply to you. You may only purchase Products from our Website if you are at least 18 years old.

3. Areas of Delivery

Products ordered via our Website are delivered exclusively within the European Union. Only orders with an invoicing and delivery address located within the EU will be processed. Orders for which a P.O. box delivery address has been chosen cannot be processed.

4. Our Products

The Products we offer for sale are those listed on the Website on the date you consult it, subject to stock availability and these Terms. All Products should be kept out of reach of children.

Images of Products on our Website are for illustrative purposes only and do not form part of the Contract. Sunsense is not liable for any minor discrepancy between an image and the Product delivered. Product packaging may vary slightly from images shown on our Website.

Product Availability. Products are offered subject to availability. If a Product is unavailable, we will inform you as soon as possible, either at the time of ordering (shown as out of stock), or after your order is placed if the Product becomes unavailable before dispatch, in which case we will contact you by email.

If a Product turns out to be unavailable after you have placed your order, we reserve the right to cancel the affected part of your order. If you have already paid for the Product, we will refund the corresponding amount — including any applicable delivery costs where the full order is affected — within 3 business days of the cancellation.

No substitute Product will be sent to replace an unavailable Product without your prior agreement. Sunsense shall not be held liable for Products being out of stock or unavailable.

Retention of title and risk. Products remain the property of Sunsense until full payment of the purchase price and any applicable delivery charges has been received. Where Products have been delivered and a payment issue arises, you agree, at your own cost, to return the Products to us upon our first request. Risk in the Products (e.g. loss or damage) transfers to you upon delivery.

5. Prices and Payment

6. Placing an Order

You may browse the Website freely with no obligation to order. To place an order, select the Products you wish to buy and add them to your cart. At any time you may review or amend your cart, continue shopping, or proceed to checkout.

You will then be asked to provide your email address and delivery/billing details, either as a registered account holder or as a guest. Before completing payment, an order summary will be shown, including: Product names, quantities and prices, delivery costs, order total, payment method, delivery and billing address, our contact details, and information about your right of withdrawal.

Definitive validation of your order. At checkout, you must verify that your delivery and billing details are correct, then confirm your chosen payment method. You must read and accept these General Conditions of Sale and our Privacy Policy (by ticking the relevant box) before completing payment. Once payment is confirmed, your order is validated, and you are bound by an obligation to pay — subject to your statutory right of withdrawal.

7. How the Contract is Formed

Our checkout process allows you to review and correct any errors before submitting your order. Once your order is submitted, you will receive an Order Acknowledgement by email summarising your order. This does not constitute our acceptance of the order.

The Contract between us is formed when we send you a Dispatch Confirmation email confirming that your Products have shipped. This email sets out the full details of the Contract, including a link to these General Conditions of Sale and information about your right of withdrawal.

Order data recorded by our systems constitutes evidence of the transactions concluded between Sunsense and you.

8. Our Right to Vary These Terms

We may update these General Conditions of Sale from time to time. Please check them each time you place an order. We may revise these Terms to reflect changes in law or regulatory requirements, or changes in our business practices. Where a revision affects an order you have already placed, we will notify you in advance and explain how to cancel the Contract if you disagree with the change.

9. Delivery

See our separate Delivery document for full delivery terms. Delivery is completed when Products are delivered to the address provided at checkout; from that point, the Products become your responsibility. You own the Products once we have received payment in full, including delivery charges.

Sunsense is not liable for delivery delays caused by an Event Outside Our Control (see Clause 12). If your delivery is late, please contact our Customer Care team as soon as possible. Upon receipt, please check that the Products match your order. Any anomalies (missing/damaged items) should be reported to our Customer Care team as soon as possible.

10. Your Right of Withdrawal, Return and Refund

11. Our Liability

If we fail to comply with these Terms, we are responsible for foreseeable loss or damage resulting from our breach or negligence, but not for loss that is not foreseeable.

Products are supplied for private, domestic use only. You agree not to use them for commercial resale, and we accept no liability for loss of profit, business, or business opportunity.

We do not exclude or limit our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • any liability which cannot be excluded or limited under applicable Dutch or EU consumer protection law, including conformity of goods and product liability.

12. Events Outside Our Control

We are not liable for any failure or delay in performing our obligations caused by an Event Outside Our Control — meaning any act or event beyond our reasonable control, including strikes, civil unrest, war, fire, explosion, flood, epidemic, natural disaster, failure of telecommunications or transport networks, or unauthorised intrusion into our systems.

If such an event affects our obligations under a Contract, we will notify you as soon as reasonably possible, and our obligations will be suspended for the duration of the event. If the event continues for more than 30 days, you may cancel the affected Contract. We will refund the price paid, including delivery charges, for any Products already paid for but not received.

13. Other Important Terms

  • We may transfer our rights and obligations under a Contract to another organisation; this will not affect your rights under these Terms.
  • You may only transfer your rights or obligations under these Terms with our prior written agreement.
  • If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.
  • If we do not enforce a right under these Terms, this does not waive that right for future purposes.
  • These Terms and the Dispatch Confirmation email together form the entire agreement between us. In case of contradiction, these Terms prevail.

Governing law: These Terms and the Contract between Sunsense and you are governed by the laws of the Netherlands. Any dispute arising from or in connection with the Contract shall be submitted to the competent court in Amsterdam, the Netherlands, without prejudice to any mandatory consumer protection rights you may have in your country of residence under EU law.
